When someone is charged with CDV the police and the prosecution collect evidence and other materials in their files related to the case. This can include important items such as:
-
Police Reports
-
Victim Impact Statements
-
911 Call Audio
-
Police Video or Audio Footage
-
Witness Statements
-
Investigative Notes
-
Jail Booking Records
-
Photographs
These items may be critical to properly evaluating and preparing for a CDV trial. With their lawyer's assistance a CDV defendant can gain access to these items in advance of their Court appearance.
As a criminal defense attorney one of the first things I always do on behalf of a client is file the appropriate motions with the Court to obtain the discovery materials. Once they are received I schedule a meeting with my client to review them together and continue in evaluating the case.
